Who Does Local Law 94 Apply To?

The law applies to:

New buildings: Any new building filed for permit after November 15, 2019 must comply with Local Law 94 if the building has a roof or setback that is accessible or has mechanical equipment.

Full roof replacements: If you are replacing 100% of your existing roof membrane down to the deck, Local Law 94 applies to the new installation.

Buildings with green roof or solar exemptions: Certain portions of the roof can be exempt if occupied by mechanical equipment, skylights, or other structures — but the remaining available roof area must still comply.

The law does NOT apply to:

    Intensive green roof: Deeper growing medium (12+ inches), supports larger plants and even trees. Higher cost, requires structural assessment.

    Option 2 — Solar Photovoltaic System

    Installing a solar PV system that covers the required roof area qualifies as a compliant sustainable roof. This option is popular for building owners who want to offset energy costs while achieving compliance.

    Option 3 — Combined System
