NYC Green Roof Requirements — What Building Owners Need to Know (2025)
New York City has some of the most ambitious green building laws in the country — and if you own a building in NYC, some of them apply directly to your roof. Whether you're constructing a new building, doing a major renovation, or simply trying to understand your obligations, this guide breaks down exactly what NYC requires, what it costs, and what your options are.
What Is Local Law 94?
Local Law 94 of 2019 — also known as the NYC Sustainable Roofs Law — requires that new buildings and buildings undergoing major roof replacements install either a green roof system or a solar energy system (or a combination of both) on a significant portion of the roof surface.
The law took effect on November 15, 2019 and applies to most new construction and full roof replacements in New York City. It was designed to reduce the urban heat island effect, manage stormwater runoff, and reduce energy consumption across the city's massive building stock.
Who Does Local Law 94 Apply To?
The law applies to:
New buildings: Any new building filed for permit after November 15, 2019 must comply with Local Law 94 if the building has a roof or setback that is accessible or has mechanical equipment.
Full roof replacements: If you are replacing 100% of your existing roof membrane down to the deck, Local Law 94 applies to the new installation.
Buildings with green roof or solar exemptions: Certain portions of the roof can be exempt if occupied by mechanical equipment, skylights, or other structures — but the remaining available roof area must still comply.
The law does NOT apply to:
What Are Your Compliant Roof Options?
Under Local Law 94 you have four main paths to compliance:
Option 1 — Green Roof (Vegetated Roof)
A green roof system installs a growing medium and vegetation layer on top of a waterproof membrane. Green roofs provide excellent insulation, manage stormwater, extend roof lifespan, and qualify as a sustainable roof under Local Law 94.
Two types:
Extensive green roof: Shallow growing medium (3–6 inches), drought-tolerant plants like sedum. Lower cost, lower maintenance. Most common for compliance.
Intensive green roof: Deeper growing medium (12+ inches), supports larger plants and even trees. Higher cost, requires structural assessment.
Option 2 — Solar Photovoltaic System
Installing a solar PV system that covers the required roof area qualifies as a compliant sustainable roof. This option is popular for building owners who want to offset energy costs while achieving compliance.
Option 3 — Combined System
You can combine a green roof with solar panels to achieve compliance — a popular option for larger buildings where neither system alone would cover the full required area.
Option 4 — Cool Roof
In some cases a highly reflective cool roof coating may satisfy compliance requirements. A cool roof reflects solar heat rather than absorbing it, reducing cooling costs and urban heat island effect. This option requires approval and documentation.
How Much Does a Green Roof Cost in NYC?
Costs vary significantly based on system type and building size:
Extensive green roof: $15–$25 per square foot installed
Intensive green roof: $25–$50+ per square foot installed
Cool roof coating: $3–$8 per square foot installed
Solar PV system: $4–$8 per watt installed (before incentives)
For a typical 2,000 square foot NYC rooftop, an extensive green roof system runs $30,000–$50,000 fully installed including waterproofing membrane, drainage layer, growing medium, and planting.
Important: These costs may be partially offset by:
What Happens If You Don't Comply?
Non-compliance with Local Law 94 is identified during the NYC DOB permit and inspection process. You will not receive a Certificate of Occupancy for new construction or a sign-off on a full roof replacement permit without demonstrating compliance.
For existing buildings doing full re-roofing, your contractor must file the appropriate plans with the NYC DOB showing compliance before work begins. IronSky handles all permitting for our customers — we make sure your project is filed correctly and passes inspection.
What About Existing Buildings Not Doing Full Replacements?
If you are doing a partial repair — patching sections, fixing flashing, replacing a portion of the membrane — Local Law 94 does not apply. You can repair your existing roof without triggering the sustainable roof requirement.
This is an important distinction. Many property owners worry that any roofing work will force them into a green roof installation. That is not the case. The law only triggers on full replacements and new construction.
Green Roof Maintenance — What to Expect
A green roof is not maintenance-free. Plan for:
Annual inspection: Check drainage, membrane condition, and plant health once per year.
Weeding: Especially in the first 2–3 years while the vegetation establishes.
Irrigation: Extensive sedum roofs are drought-tolerant once established but may need irrigation during installation and dry spells.
Membrane monitoring: The waterproof membrane under the green roof must be inspected periodically — a leak under a green roof is harder to detect and more expensive to repair than a standard flat roof.
IronSky provides annual green roof inspection services to ensure your membrane stays watertight and your system stays compliant.

Local Law 94 of 2019, also known as the NYC Sustainable Roofs Law, requires new buildings and buildings undergoing full roof replacements to install either a green roof, solar panels, or a qualifying cool roof system on a significant portion of the roof surface.
Does Local Law 94 apply to roof repairs?+
No. Local Law 94 only triggers on full roof replacements and new construction. Partial repairs, patching, flashing repairs, and membrane repairs that do not remove the entire roof down to the deck are exempt.
How much does a green roof cost in NYC?+
Extensive green roofs typically cost $15–$25 per square foot installed, while intensive green roofs run $25–$50+ per square foot. A 2,000 sq ft extensive green roof generally costs $30,000–$50,000 fully installed. Cool roof coatings are $3–$8 per square foot.
What roof options qualify under Local Law 94?+
Qualifying options include vegetated green roofs, solar photovoltaic systems, combined green roof plus solar systems, and in some cases approved cool roof coatings. The right choice depends on your building, budget, and roof structure.
What happens if a building doesn't comply with Local Law 94?+
Non-compliance is identified during the NYC DOB permit and inspection process. New buildings cannot receive a Certificate of Occupancy, and full roof replacement permits cannot be signed off until compliance is demonstrated.
